Terms & Conditions

Last updated: 25 July 2026

1. Introduction and Acceptance of Terms

Welcome to My Cake Order — Pro ("the Platform", "we", "us", or "our"), an online marketplace that connects clients seeking custom cakes, cupcakes, and baked goods with independent bakers ("Bakers"). By accessing, browsing, registering an account, placing an order, or listing products on the Platform, you ("the User", "you") accept and agree to be bound by these Terms and Conditions ("Terms") in full.

If you do not agree with any part of these Terms, you must not use the Platform. These Terms apply to all users regardless of whether you are a client, a Baker, a corporate account holder, or a visitor browsing the style library.

2. Company Information

My Cake Order — Pro is operated and owned by:

  • Registered Name: Oojoo Holdings (Pty) Ltd
  • Registration Number: 2019/013765/07
  • Registered Address: Maria Street, Robindale, Randburg, 2194, South Africa
  • Email: enquiry@mycakeorder-pro.online
  • Platform Name: My Cake Order — Pro

Oojoo Holdings (Pty) Ltd is a private company incorporated in the Republic of South Africa in accordance with the Companies Act, No. 71 of 2008.

3. Platform Description and Services

The Platform provides the following services:

  • An AI-assisted cake and cupcake concept design studio for clients to visualise and save design ideas.
  • A style library showcasing design templates for cakes, cupcakes, and festive cakes.
  • A marketplace connecting clients with registered Bakers for the production of custom orders.
  • Tools for Bakers including recipe costing, invoice generation, and order management.
  • A quotation and order workflow between clients and Bakers.

My Cake Order — Pro acts as a facilitator and intermediary. We do not bake, produce, or deliver any goods ourselves. All baked products are designed, produced, and delivered by independent Bakers.

4. User Accounts and Registration

To access certain features you must register an account. You agree to provide accurate, current, and complete information during registration and to keep that information updated. You are responsible for safeguarding your password and for all activity conducted under your account.

Users may register as a client, corporate account, or Baker. Bakers may be required to provide business registration documentation and verify their identity before listing products or accepting orders. We reserve the right to suspend or terminate accounts that violate these Terms or applicable law.

5. Platform Fee

Upon a successful sale facilitated through the Platform, a commission of 20% (twenty percent) of the total order value is payable to My Cake Order — Pro. This fee is deducted from the Baker's payout and covers the use of the Platform, its AI design tools, marketplace listing, payment processing, and dispute facilitation services.

The 20% platform fee applies to all completed transactions where payment has been released to the Baker. It does not apply to orders that are cancelled, refunded, or disputed and resolved in the client's favour. Bakers acknowledge that the platform fee is a condition of using the marketplace and agree to its deduction at the point of payout.

6. Orders, Payments, and Pricing

Clients may submit requests for custom cakes and receive quotations from Bakers. All prices displayed are set by the individual Baker and are inclusive of the platform fee unless otherwise stated. By accepting a quotation, the client enters into a direct agreement with the Baker for the production and delivery of the order.

Payments are processed through the Platform's secure payment gateway. For most custom orders, payment is released to the Baker in two stages: a 50% deposit upon order acceptance and the remaining balance upon confirmed delivery or collection. My Cake Order — Pro holds funds in escrow until the order is marked as received by the client.

7. Cancellation Policy

7.1 Cancellation by the Client

  • More than 7 days before the date needed: Full refund of any deposit paid, less applicable payment processing fees.
  • Between 3 and 7 days before the date needed: 50% of the deposit is refundable.
  • Less than 3 days before the date needed: No refund of the deposit, as the Baker will have commenced production and incurred costs.

7.2 Cancellation by the Baker

If a Baker is unable to fulfil an accepted order, they must notify the client and the Platform immediately. The Baker forfeits any right to payment and the client receives a full refund. Repeated cancellations may result in suspension from the Platform.

7.3 Cancellation by the Platform

We reserve the right to cancel any order or listing that violates these Terms, applicable law, or where fraud is suspected. Affected parties will be notified and any held funds returned.

8. Refund Policy

Refunds are considered on a case-by-case basis in accordance with the South African Consumer Protection Act, No. 68 of 2008 ("CPA") and these Terms. A client may be entitled to a refund where:

  • The delivered product materially deviates from the agreed design or quotation.
  • The order is not delivered by the agreed date and time.
  • The product is unfit for human consumption or poses a health or safety risk.
  • The Baker cancels the order after payment has been made.

Refund requests must be submitted through the Platform within 48 hours of delivery or collection, accompanied by photographic evidence where applicable. Custom-designed cakes are made to order and, due to their bespoke nature, are not subject to a general "cooling-off" return right except where there is a material defect as described above.

Approved refunds will be processed to the original payment method within 7 to 14 business days. The 20% platform fee is not charged on refunded orders.

9. Dispute Resolution

Both clients and Bakers may raise a dispute through the Platform's dispute facility. We encourage parties to attempt to resolve disputes directly first. Where this is not possible, My Cake Order — Pro will act as an impartial facilitator and may request evidence from both parties including photographs, communications, and delivery confirmations.

9.1 Internal Dispute Process

  • The dispute is logged and both parties are notified.
  • Each party has 72 hours to submit evidence and a response.
  • The Platform reviews the evidence and issues a resolution decision, which may include a partial or full refund, release of held funds, or dismissal of the dispute.

9.2 External Resolution

If a dispute remains unresolved through the Platform's internal process, either party may refer the matter to the relevant consumer protection authority or seek resolution through arbitration or the courts as set out in Section 13. South African users may refer matters to the National Consumer Tribunal or the applicable Ombud where jurisdiction applies.

10. Warranties and Limitation of Liability

Bakers warrant that all products listed and sold through the Platform comply with applicable food safety, hygiene, and health regulations, including the South African Foodstuffs, Cosmetics and Disinfectants Act, No. 54 of 1972. Bakers are solely responsible for the quality, safety, and fitness for purpose of their products.

AI-generated cake concepts are provided as creative starting points only and do not constitute a guarantee of the final product. The final outcome depends on the Baker's skill and craftsmanship.

To the maximum extent permitted by law, My Cake Order — Pro, its directors, employees, and affiliates shall not be liable for any indirect, incidental, or consequential damages arising from the use of the Platform or from transactions between clients and Bakers. Our liability is limited to the platform fee collected on the transaction in question.

11. Intellectual Property

All Platform content, including the style library, AI design tools, branding, software, and interface, is the intellectual property of Oojoo Holdings (Pty) Ltd or its licensors and is protected under South African and international copyright and trademark law. Users may not copy, reproduce, or distribute Platform content without written consent.

Cake concepts generated by users remain the user's design reference. Bakers retain ownership of their original recipes and branding but grant the Platform a licence to display them for the purpose of facilitating orders.

12. Privacy and Data Protection

We process personal data in accordance with the Protection of Personal Information Act, No. 4 of 2013 ("POPIA") and, where applicable, the General Data Protection Regulation (GDPR) for international users. Personal information is collected for account management, order processing, payment facilitation, and dispute resolution.

We do not sell your personal information. Bakers and clients may access and update their personal information through their account settings. For privacy enquiries, contact enquiry@mycakeorder-pro.online.

13. Governing Law and Jurisdiction

13.1 South African Users

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any dispute shall be subject to the exclusive jurisdiction of the Magistrates' Court or High Court of South Africa sitting in Johannesburg, Gauteng, save where the CPA provides for alternative dispute resolution.

13.2 International Users

For users accessing the Platform from outside South Africa, these Terms remain governed by South African law. However, international users retain any mandatory consumer rights afforded by the laws of their country of residence, which shall not be contracted out of by these Terms. Where a conflict arises between South African law and mandatory local consumer protection law, the mandatory local law shall prevail in respect of that user's rights.

14. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services, applicable law, or operational requirements. Material changes will be communicated to registered users via email or in-app notification at least 14 days before they take effect. Continued use of the Platform after the effective date constitutes acceptance of the revised Terms.
